Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Quastus platform at app.quastus.com and the website at quastus.com (collectively, the “Service”), operated by Quastus (“we,” “us,” or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Description of Service

Quastus is an educational platform that enables teachers to create AI-generated lesson presentations and conduct live classroom sessions where students can reflect, ask questions, and receive AI-powered feedback. The Service includes:

  • AI-assisted lesson planning and presentation generation
  • Real-time classroom sessions with student participation
  • AI-powered student reflection feedback and understanding assessment
  • Assignment creation, submission, and grading
  • Integration with Google Workspace (Docs, Slides, Classroom) for content and roster import
  • Media asset management for lesson materials

2. Accounts and Registration

2.1 Account Types

  • Teacher accounts: Created by teachers or school administrators. Require email and password.
  • Student accounts: Created when students join sessions using email codes provided by their teacher.
  • School administrator accounts: Created by school administrators for managing their school’s usage.

2.2 Account Responsibilities

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You may not share your account credentials with others
  • Teachers are responsible for managing student access to their sessions

2.3 Age Requirements

  • Teachers and administrators must be 18 years of age or older
  • Students may use the Service under the supervision of their teacher and school
  • Students under 13 may only use the Service when their school has provided consent on behalf of their parents in accordance with COPPA

2.4 School Accounts

When a school registers for the Service:

  • The school administrator manages teacher and student accounts within the school
  • The school is responsible for ensuring appropriate use by its staff and students
  • The school is responsible for obtaining necessary parental consents for students under 13

3. Acceptable Use

3.1 You May

  • Use the Service for legitimate educational purposes
  • Create and share lesson content with your students
  • Import content from Google Workspace for use within the Service
  • Export your content from the Service

3.2 You May Not

  • Use the Service for any unlawful purpose
  • Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Attempt to gain unauthorized access to other users’ accounts or data
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to harvest, collect, or store personal data of other users without authorization
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access the Service without our written permission
  • Resell, sublicense, or redistribute the Service without our written permission
  • Circumvent any access controls, security measures, or usage limits

3.3 Content Standards

All content uploaded to the Service must be:

  • Appropriate for an educational setting
  • Free of malware, viruses, or other harmful code
  • Content you have the right to use (you own it or have permission)

We reserve the right to remove content that violates these standards.


4. Intellectual Property

4.1 Your Content

You retain ownership of all content you create or upload to the Service, including:

  • Lesson plans, topics, and planning documents
  • Presentation content and slides
  • Assignments and grading materials
  • Media assets you upload

By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content as necessary to provide the Service. This license terminates when you delete your content or your account.

4.2 AI-Generated Content

Content generated by AI features of the Service (lesson structures, reflection responses, understanding assessments) is provided for your use within the Service. You may use AI-generated content in your teaching activities.

AI-generated content is provided “as is.” You are responsible for reviewing AI-generated content for accuracy and appropriateness before using it with students.

4.3 Our Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Quastus and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.

4.4 Imported Content

When you import content from Google Workspace:

  • You represent that you have the right to import and use that content
  • The imported content is subject to the same terms as content you create directly
  • We do not claim ownership of content imported from your Google account

5. Google Workspace Integration

5.1 Authorization

Connecting your Google account to Quastus is optional. When you connect, you authorize us to access specific Google data as described in our Privacy Policy. You can revoke this authorization at any time.

5.2 Google’s Terms

Your use of Google Workspace products (Docs, Slides, Classroom) is governed by Google’s own terms of service. Our integration with Google Workspace is subject to the Google API Services User Data Policy.

5.3 Data Handling

We handle Google data in accordance with our Privacy Policy, including the Limited Use requirements of the Google API Services User Data Policy.


6. Student Data

6.1 Teacher Responsibilities

Teachers using the Service are responsible for:

  • Ensuring their school has appropriate policies and consents in place for student data
  • Using student data only for legitimate educational purposes
  • Not sharing student data outside the Service without appropriate authorization
  • Complying with applicable student data privacy laws (FERPA, COPPA, state laws)

6.2 Our Responsibilities

We handle student data in accordance with our Privacy Policy and applicable laws including FERPA and COPPA. We:

  • Use student data only to provide the educational Service
  • Do not sell student data
  • Do not use student data for advertising
  • Maintain appropriate security safeguards
  • Support schools in meeting their privacy obligations

6.3 Data Processing Agreements

Schools may request a Data Processing Agreement (DPA) governing our handling of student data. Contact us at help@quastus.com to initiate a DPA.


7. AI Features and Limitations

7.1 AI-Powered Features

The Service uses artificial intelligence (currently powered by OpenAI) for:

  • Generating lesson structures and presentation content
  • Providing feedback on student reflections
  • Assessing student understanding levels
  • Assisting with assignment-related queries

7.2 Limitations

AI-generated content may contain errors, inaccuracies, or biases. Teachers should:

  • Review all AI-generated content before using it with students
  • Not rely solely on AI assessments for grading or evaluation decisions
  • Use professional judgment when interpreting AI understanding assessments

7.3 No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, or reliability of AI-generated content. The Service is a tool to assist educators, not a replacement for professional educational judgment.


8. Availability and Support

8.1 Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Unplanned outages or technical issues
  • Force majeure events

8.2 Modifications

We may modify, update, or discontinue features of the Service at any time. For material changes that significantly affect your use:

  • We will provide reasonable advance notice
  • You may terminate your account if you do not agree with the changes

8.3 Support

We provide support via email at help@quastus.com. Response times may vary based on the nature of the request and current volume.

10. Termination

10.1 By You

You may stop using the Service and request account deletion at any time by contacting us at help@quastus.com. Upon deletion:

  • Your personal data will be deleted within 30 days
  • Content you created may be retained in anonymized form
  • Student data associated with your school will be handled according to our data retention policy

10.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Use the Service in a way that could harm other users or the Service
  • Fail to pay applicable fees (when payment terms are in effect)

Before termination, we will:

  • Provide notice and an opportunity to remedy the violation (except in cases of severe or repeated violations)
  • Allow you to export your data before termination takes effect (where feasible)

10.3 Effect of Termination

Upon termination:

  • Your right to use the Service ends immediately
  • We will delete your data in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination (intellectual property, limitation of liability, indemnification) will survive

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE
  • AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR APPROPRIATE
  • THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS
  • DEFECTS WILL BE CORRECTED IN A TIMELY MANNER

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUASTUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.


13. Indemnification

You agree to indemnify and hold harmless Quastus, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or create through the Service

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at help@quastus.com and attempt to resolve the dispute informally for at least 30 days.

14.2 Governing Law

These Terms are governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of law provisions.

14.3 Jurisdiction

Any disputes arising from these Terms or the Service that cannot be resolved informally shall be resolved in the courts of [State/Country]. You consent to the personal jurisdiction of such courts.


15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quastus regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

15.4 Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.

15.5 Notices

We may send notices to you via email to the address associated with your account. You may send notices to us at help@quastus.com.


16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on this page with a new “Last Updated” date
  • Sending an email to registered users for significant changes
  • Providing in-app notice for changes that affect your use of the Service

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service.
